California Expands Sexual Harassment & Posting Requirements
The California Fair Employment and Housing Act (“FEHA”) requires employers with 50 or more employees to provide at least two hours of training and education regarding sexual harassment to all supervisory employees within six months of their assumption of a supervisory position and once every two years.
Effective January 1, 2018, SB 396 will modify the required training* to include issues of harassment based on gender identity, gender expression, and sexual orientation. The training must include specific examples of such harassment. Employers should consider utilizing trainers who have the knowledge and expertise to effectively communicate these new subject areas.
Furthermore, employers will be required to display a poster regarding transgender rights prepared by the California Department of Fair Employment and Housing (DFEH). A revised poster will become available January 1 on the DFEH website.
