New Indoor Heat Protection Laws Soon to Become Effective

New Law directs Cal-OSHA to draft and propose heat illness prevention standards for indoor worksites by January 1, 2017.

California SB1167, signed by Governor Brown on September 29, 2016, directs Cal-OSHA to propose to the OSHA Safety Board for their review and adoption, a heat illness and injury prevention standard applicable to workers working in indoor places of employment.

In an article written by Atkinson, Andelson, Loya, Ruud & Romo, an employment labor law firm, "...existing California law already protects employees from working in dangerous conditions indoors. Most California employers are required to establish and implement an effective Injury and Illness Prevention Program ("IIPP").

Although these heat illness standards will not go into effect until 2019, employers may wish to take some proactive steps to begin reviewing their current IIPP written plans. Employers with 10 or more employees are require to implement and maintain a written IIPP for their business, in addition to other mandatory safety plans.
