Pregnancy Disability Leave Amendments Bring Poster Changes
Recent amendments to California's Pregnancy Disability Leave (PDL) regulations take effect April 1, 2016. The amendments include clarifications regarding PDL, as well as changes to the mandatory state posting (Notice A).
PDL regulations apply to employers with five or more employees. Employers who fall under this threshold are required to post a specific poster (e.g., Notice A) which explains an employee's rights and obligations regarding pregnancy, childbirth or related medical conditions. The revised notice includes the following:
1) an employee's right to request reasonable accommodation, transfer or pregnancy disability leave; 2) the employee's obligations to provide adequate advance notice; and 3) the employer's requirements, if any, that the employee provide medical certification of the need for pregnancy disability leave, reasonable accommodation or transfer.
The revised notice is require beginning April 1, 2016. A copy of the notice can be found on the DFEH website (link provide below).
UPDATE (3/12/16): Based on our last visit to the DFEH's website, a revised notice does not appear to be available just yet. The HRC is in the process of communicating with the state to determine if a new notice will be provided to employers or if the current version of the notice is acceptable. Please check back for any updates as we get them.
